These Terms & Conditions (“Terms”) govern your access to and use of Business Website Express, including our website, Eva assistant, checkout links, intake process, website packages, add-ons and related services. By using the website or purchasing a package, you agree to these Terms.
1. Our service
Business Website Express provides streamlined website packages for small businesses. Depending on the plan selected, services may include a one-page website, mobile-friendly layout, basic copy assistance, contact form or call-to-action, social links, domain and hosting for the first year, FAQ section, basic legal page templates, one basic revision round and/or Eva chatbot setup.
2. Self-service process
The service is designed to be purchased online without a sales call. Eva may help you understand plans, answer common questions, recommend a package, explain add-ons and send you to checkout. After payment, you must complete the intake form and provide all required information before production begins. Optional add-ons are usually handled after the main plan is chosen so the checkout stays simple.
3. Delivery timing
Delivery timing begins only after payment is completed and the required intake information is submitted.
- Website Start: basic delivery target of 6–12 hours after complete intake.
- Website Pro: typical delivery target of 12–24 hours after complete intake.
- Website + Eva: typical delivery target of 24–48 hours after complete intake.
Delivery targets are estimates, not guarantees. Delays may occur due to incomplete information, unclear instructions, missing assets, domain issues, technical outages, third-party tool issues, payment review, workload, requests outside the original scope or add-ons requested after checkout.
4. What is not included
Unless specifically stated in writing, the following are not included in base packages:
- Custom software development or custom-coded web applications.
- Ecommerce stores, subscriptions, memberships or payment portals beyond simple payment links.
- Advanced booking systems, CRM integrations, API integrations or complex automations.
- Ongoing maintenance, security monitoring, backups, SEO campaigns, ads management or monthly updates.
- Premium domains, domain renewals after the first year, business email, paid plugins or third-party platform fees.
- Legal review, tax advice, regulated-industry compliance review or professional licensing review.
- Unlimited revisions or changes outside the purchased scope.
5. Customer responsibilities
You are responsible for providing accurate, complete and lawful information, including business details, contact information, images, logos, brand assets, service descriptions, offers, pricing, claims and any required disclosures. You represent that you have the right to use all materials you submit.
6. Content, AI assistance and review
We may use AI-assisted tools to draft, structure, edit or improve content and visuals. Human review may be used before delivery, but you are responsible for reviewing the final website and confirming that all business claims, prices, services, legal statements, images and contact details are accurate and lawful.
7. Revisions
Website Pro and Website + Eva include one basic revision round. A basic revision means small adjustments to text, images, layout, colors, links or contact details within the original scope. New pages, new sections, major redesigns, new strategy, new copy direction, custom functions or changes based on missing original information may require an add-on or separate quote. Extra revisions may also be purchased separately.
8. Payments
Payments are processed online through third-party payment providers. Prices are shown in U.S. dollars unless otherwise stated. Taxes, payment processing fees, currency conversion fees or third-party charges may apply. Payment must be completed before production begins. Optional add-ons may be purchased later through Eva, through your intake process or through a separate payment link.
9. Klarna and pay-over-time options
Klarna or other pay-over-time options may appear at checkout only when available and eligible through the payment provider. Availability may depend on the customer’s location, transaction, currency, provider settings, business eligibility and underwriting decisions. We do not control approval decisions for pay-over-time providers.
10. Refunds and cancellations
Because production can begin quickly after payment and intake, payments are generally non-refundable once work has started or project assets have been prepared. If you request cancellation before work begins, we may review the request case by case. Payment provider fees, domain purchases, hosting setup, third-party charges, completed work and purchased add-ons may be non-refundable.
11. Domain and hosting
Base packages may include one standard domain and basic hosting for the first year, subject to domain availability. Premium domains, special extensions, renewal fees after the first year, business email, advanced hosting, migrations and technical support beyond the purchased scope are not included unless stated in writing.
12. Ownership and license
After full payment, you may use the final delivered website content and design for your business, subject to any third-party tool, stock asset, font, platform or software license restrictions. We retain ownership of our templates, systems, workflows, reusable code, prompts, processes, know-how and internal production methods.
13. Third-party services
The service may rely on third-party tools such as payment processors, hosting providers, domain registrars, form tools, analytics tools, email tools, automation platforms or AI tools. We are not responsible for outages, policy changes, fees, limitations or failures caused by third-party services.
14. No guarantee of results
We do not guarantee sales, leads, rankings, conversions, ad results, revenue, approvals, traffic or business outcomes. A website can improve presentation and credibility, but results depend on many factors outside our control.
15. Prohibited uses
You may not use our services for unlawful, deceptive, harmful, infringing, fraudulent, abusive, discriminatory or prohibited activities. We may refuse or cancel service for businesses, content or requests that create legal, reputational, payment or operational risk.
16. Limitation of liability
To the fullest extent permitted by law, Business Website Express will not be liable for indirect, incidental, special, consequential, punitive or lost-profit damages. Our total liability for any claim related to the service will not exceed the amount you paid for the specific package giving rise to the claim.
17. Indemnification
You agree to defend, indemnify and hold harmless Business Website Express from claims, damages, losses, liabilities, costs and expenses arising from your content, business claims, misuse of the service, violation of these Terms, violation of law or infringement of third-party rights.
18. Privacy
Your use of the website and services is also governed by our Privacy Policy.
19. Changes to these Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date. Continued use of the website or services after changes means you accept the updated Terms.
